Motion for Recusal

of Judge Worrell

So far, Charlottesville Judge Worrell has not stepped aside and recused himself as his colleagues have done in both Arlington and Alexandria, VA.  The judges on the Arlington County Circuit recused themselves from the Missing Middle zoning lawsuit due to a perceived conflict of interest stemming from their status as homeowners in Arlington County. This recusal was based on the potential impact the zoning changes could have on their own properties, which might have influenced their impartiality in the case.

Judge Worrell's impartiality is in question. He has refused to recuse himself even though he lives in Charlottesville and his decision on the case could impact zoning on his own house. Below is the motion to recuse Judge Worrell and next to it is the response from teh City Coiuncil as to why they doesn't think a conflict exists.
